Terms and Conditions | Marbella Luxury Car Rental

Marbella Luxury Car Rental is the trading brand operating marbellaluxurycarrental.es, offering luxury and sports car rental, chauffeur-driven hire, wedding car hire and airport delivery in and around Marbella. These terms apply to every booking made through the website, by email, by phone or via WhatsApp, and they sit alongside the written quote we send you, which forms part of the contract for that specific rental.

Nothing is booked just because you filled in the enquiry form or sent us a message. The process works like this:

• You send an enquiry (name, email, phone if you give it, chosen car if known, pick-up and drop-off dates, flight number for airport delivery, and any message) or contact us directly by email, phone or WhatsApp.
• We reply with a written quote covering the car, dates, price and what is included.
• The booking only becomes binding once we confirm it in writing — a booking confirmation email or message from us.

Until that written confirmation exists, either side is free to walk away without charge.

Day rates start from €210 and vary by car, dates and duration; the exact price for your rental is the one stated in your written quote, not any rate shown elsewhere on the site. Unless your quote says otherwise, the price includes the car for the agreed dates, 200 km of daily mileage and the insurance cover described in the quote.

Extras such as additional drivers, child seats, delivery beyond the agreed point, chauffeur service or extended mileage are only included if they are listed in your quote.

We do not take payment through the website. Payment terms for the rental itself are set out in your written quote and confirmed in writing before pickup.

At handover, a refundable security deposit is held on a credit card in the main driver's name, ranging from €1,500 to €250,000 depending on the car booked. The deposit is released within 21 days after the car is returned, once we have checked for fines, tolls and any damage.

Because a car rental booking is a service tied to specific dates, the 14-day right of withdrawal that applies to most distance contracts does not apply here. This is set out in Article 16(l) of Directive 2011/83/EU and, in Spain, in Article 103(l) of Royal Legislative Decree 1/2007 — leisure services booked for a specific date or period are excluded from the withdrawal right. Instead, we apply the voluntary cancellation policy below.

• Free cancellation up to 7 days before pickup.
• Between 7 days and 24 hours before pickup: 30% of the booking value is charged.
• Within 24 hours of pickup: 100% of the booking value is charged.

Requests to change dates or the car booked are handled the same way as a cancellation plus a new enquiry; where possible we will try to accommodate changes without charge if made well in advance, but this is not guaranteed.

We may need to cancel or amend a confirmed booking for reasons outside our control, such as adverse weather, a safety concern, a technical fault discovered in the vehicle, or force majeure. In these cases we will tell you as soon as we reasonably can and offer either an equivalent or similar vehicle, a new date, or a full refund of any amount already paid for the affected booking. We are not liable for indirect losses — such as flights, hotels or events arranged around the rental — arising from a cancellation made for these reasons.

• The main driver must be at least 25 years old and hold a licence for at least 3 years.
• A valid driving licence, passport or ID, and a credit card in the main driver's name must be presented at handover.
• An International Driving Permit may be required for licences issued outside the EU.

Handover and return take place at the point, date and time agreed in the booking confirmation — our deliveries are built around where our clients actually are, whether that's a villa gate in La Zagaleta, a hotel arrival at Puente Romano, or an airport pickup timed to your flight. The car is inspected and photographed with you at both handover and return; any pre-existing marks are noted at handover.

• Mileage: 200 km per day is included; extra kilometres are charged at the rate stated in your quote.
• Fuel: the car must be returned with the same fuel level as at handover; any shortfall is charged at cost plus a refuelling service fee.
• Fines, tolls and parking charges incurred during your rental are your responsibility and will be passed on to you with an administrative fee once notified to us.

Insurance is included as described in your quote. In the event of at-fault damage, the renter is liable for the excess set out in that quote, which may be deducted from the security deposit.

The following are prohibited unless we have given prior written approval:

• Driving the car outside Spain.
• Track days or off-road driving.

Smoking and pets are not allowed in any of our cars. Any use outside these terms may void insurance cover and make the renter liable for the full cost of resulting damage.

Our liability in connection with a booking is limited to the price paid for that booking, except for damage, fines, tolls or deposit-related amounts due from the renter under these terms, and except where liability cannot legally be limited. We are not liable for indirect or consequential losses such as missed flights, events or other travel arrangements.

The content of marbellaluxurycarrental.es — text, photos, car listings and descriptions — belongs to Marbella Luxury Car Rental or its licensors and may not be copied or reused without our written permission. The site is provided for the purpose of enquiring about and arranging car rental in Marbella; using it to submit false information or to attempt to disrupt the site or booking system is not permitted.

These terms are governed by Spanish law. Any dispute arising from a booking will be submitted to the courts of Spain, without prejudice to any mandatory consumer-protection rules that give you the right to bring proceedings before the courts of your own place of residence.

We may update these terms from time to time; the version published on marbellaluxurycarrental.es at the time of your written booking confirmation is the one that applies to that booking.
